The Poosting Service is offered by Poosting Rede Social Ltda., and these Terms represent a legal agreement between you and the company. If you do not agree to these Terms, please do not access or use Poosting.

To ensure a safe, healthy, and respectful environment, the following content is expressly prohibited on Poosting:

1. Illegal Content
Any material that violates local, national, or international laws.
Distribution of drugs, weapons, ammunition, or controlled items.
Instructions for criminal or illicit activities.

2. Hate Speech and Discrimination
Posts that promote racism, xenophobia, sexism, homophobia, transphobia, or ableism.
Content that encourages harassment, intimidation, or attacks on individuals or groups based on their religion, ethnicity, gender, sexual orientation, or social status.

3. Violence and Incitement
Graphic or explicit violent content without an educational or journalistic context.
Incitement to violence, terrorism, self-harm, or suicide.
Promotion of extremist organizations.

4. Sexual Exploitation and Adult Content
Pornography or explicit nudity.
Sexual exploitation of minors (zero tolerance).
Sexual content without consent.
Disclosure of intimate material of third parties without authorization (“revenge porn”).

5. Bullying, Harassment, and Threats
Messages intended to intimidate, embarrass, or humiliate.
Persistent harassment, stalking, or harassment.
Physical or psychological threats against any person.

6. Disinformation and Misleading Content
Dissemination of fake news that may cause social, political, or public health harm.
Fraud, financial scams, or pyramid schemes.
Fake profiles impersonating other people or organizations.

7. Privacy and Personal Data
Sharing of third parties’ personal information without consent (such as phone numbers, addresses, documents).
Publishing private images or recordings without permission.

8. Intellectual Property
Unauthorized reproduction or distribution of copyrighted materials (music, films, books, software, etc.).
Misuse of trademarks or logos.

9. Spam and Misuse of the Platform
Sending unsolicited bulk messages.
Automated content that interferes with the normal operation of the network.
Malicious links, viruses, malware, or phishing.

Our mission at Poosting is to strengthen connections with the people and interests you value. To do this, we are committed to offering the Poosting Service, which includes all the products, features, applications, technologies, and software we develop.

The Service includes the following aspects:

• Opportunities for personalization, connection, and creation: We recognize that every person is unique. That’s why we provide various features to help you create, share, expand your presence, and communicate both inside and outside of Poosting. Our goal is to strengthen your connections through meaningful experiences. To achieve this, we use systems that seek to understand your interests and those of others, to help you create, find, and participate in relevant experiences. Part of our work is to suggest content, features, offers, and accounts that may be of interest to you, providing a unique experience based on your activities on and off the platform.
• Promotion of a safe and positive environment: We create and use tools and resources to ensure our community members’ experiences are positive and inclusive, offering support when needed. Our teams and systems work actively to combat abuse, violations of our Terms and policies, as well as deceptive or harmful conduct. We use all available information, including yours, to maintain the platform’s security. • Development of technologies for community growth: The organization and analysis of data are fundamental to our Service. That’s why we invest in cutting-edge technologies like artificial intelligence and machine learning, which allow us to personalize, protect, and enhance the Service on an incredibly large, global scale. • Integration with other products from Poosting Rede Social Ltda.: Poosting is part of the Poosting Rede Social Ltda. group. Additionally, we facilitate interaction between the different Poosting Rede Social Ltda. products, creating a unified and continuous experience, depending on your choices.
• Ensuring global access to the Service: To operate our Service worldwide, we need to store and transfer data between our systems in different locations, including outside your country of residence. The use of this global infrastructure, which may be owned or operated by Poosting Rede Social Ltda., is essential for providing our Service. 2. How the Service is Funded

Instead of charging for the use of Poosting, you agree that we may display ads from companies and organizations that pay us to promote their products and services. We use your personal data, such as information about your activities and interests, to show you more relevant ads.

We display useful and personalized ads without revealing your identity to advertisers. We do not sell your personal data. Advertisers inform us about the type of audience they want to reach, and we show the ads to people who may be interested in them.

We also provide performance reports to advertisers so they can understand how people interact with their content. These reports include demographic data and general interest information, but not data that can directly identify you, such as your name or email, unless you give us explicit permission. 3. The Privacy Policy

Providing our Service requires the collection and use of your information. Our Privacy Policy details how this information is collected, used, and shared across Poosting Rede Social Ltda. products. It also explains the ways you can manage your data, including in the Privacy and Security Settings. To use Poosting, you must agree to the Privacy Policy.

4. Your Commitments

For us to provide our Service, we ask that you agree to the following commitments.

4.1. Conditions of use: We aim for our Service to be as open and inclusive as possible, but also safe and compliant with the law. Therefore, we require you to meet certain restrictions to be part of the community.

• You must be at least 18 years old.
• You must not have legal restrictions on receiving our Service or making related payments.
• Your account must not have been deactivated by us due to a violation of laws or policies.
• You must not have been convicted of a sexual offense.

4.2. Prohibited uses: To maintain a safe environment for everyone, it is necessary for everyone to do their part.

• Do not impersonate others or provide false information. You don’t need to reveal your identity, but your registration information, including personal data, must be accurate and up to date. It is forbidden to impersonate someone else or create an account for another person without their express permission.
• Do not engage in illegal, deceptive, fraudulent, or unauthorized activities.
• Do not violate (or help or encourage others to violate) these Terms or our policies, including the Community Standards and the Poosting Rede Social Platform Terms. If you post branded content, you must follow our Branded Content Policies and use the appropriate tool. You can report any post directly to our team.
• Do not interfere with or disrupt the intended operation of the Service. This includes the misuse of reporting channels or resources, such as making false or unsubstantiated reports.
• Do not attempt to create accounts, access, or collect information in an unauthorized manner. This includes using automated methods to access or collect information without our explicit permission.
• Do not sell, license, or purchase accounts or data obtained from our Service. This includes attempts to buy, sell, or transfer any part of your account (including your username), solicit or collect login credentials or badges from other users.
• Do not post private or confidential information of others without permission, or violate others’ rights, including intellectual property rights. You may use the works of others if permitted by legal exceptions, but you declare that you have all the necessary rights for the content you post. • Do not modify, translate, create derivative works from, or reverse engineer our products or their components.
• Do not use a domain name or URL in your username without our prior written consent.
• Do not attempt to circumvent or bypass any technological measures that control or limit access to the Service or data.

4.3. Permissions you grant us: For us to provide the Service, you grant us the following permissions.

• License to use your content: We do not claim ownership of your content. You remain the owner and can share it as you wish. However, to operate the Service, you grant us a global, non-exclusive, royalty-free, transferable, and sublicensable license to host, use, distribute, modify, publicly display, translate, and create derivative works from your content (consistent with your privacy and app settings). This license ends when your content is removed from our systems, which can be done by individually deleting the content or your entire account. • Permission to use your name, profile photo, and interaction information: You authorize us to display your username, profile photo, and information about your actions (like likes) or connections (like accounts you follow) next to or in connection with accounts, ads, offers, and other sponsored content on Poosting Rede Social Ltda. products, without any compensation. For example, we might show that you liked a sponsored post from a brand that paid us to display its ads on Poosting. Just like with other interactions, these actions are only visible to those who have permission to view or follow the content.
• Service updates: You agree that we may download and install Service updates on your device.

5. Additional Poosting Rights

• We may change your username or similar identifier if we deem it appropriate or necessary, for example, if it infringes on someone else’s intellectual property.
• If you use our copyrighted content (such as images, designs, or videos that we provide), we will retain all rights to our material (but not to yours).
• You may only use our intellectual property, trademarks, or similar marks as expressly authorized by our Brand Guidelines or with our prior written permission.
• It is forbidden to modify, create derivative works from, decompile, or otherwise attempt to extract our source code without our written permission or an open-source license.

6. Content Removal and Account Termination

We may remove any content or information you share if we believe it violates these Terms of Service or our policies (including the Community Standards), or if required by law. We work with independent fact-checkers to combat misinformation and may add warnings to content classified as false.

We may suspend or terminate your access to the Service (including Poosting and Poosting Rede Social Ltda. products) if you violate these Terms or policies, create a legal risk for us, repeatedly infringe on others’ intellectual property rights, or if we are legally obligated to do so. If you believe your account was terminated by mistake, or if you wish to deactivate or permanently delete it, access our Help Center.

When you request to delete content or an account, the removal process begins within 30 days. The complete deletion of the content may take up to 90 days, and it will not be visible to other users during this period. After deletion, it may take another 90 days to remove the content from our backup systems.

Deletion may be delayed in certain circumstances:

• If the content has been used by others in accordance with the license and they have not removed it (the license will continue to apply).
• If deletion cannot be completed within 90 days due to technical limitations. In this case, removal will be done as soon as technically possible.
• If retention is necessary to:
  • Investigate illegal activities or violations of our terms and policies.
  • Protect our products, systems, and users.
  • Comply with legal obligations, such as preserving evidence.
  • Respond to a request from a judicial or administrative authority. In these situations, the content will be retained only for the time strictly necessary for these purposes.

If your account is deleted or disabled, or if this agreement is otherwise terminated, the sections on “Your Commitments” and “Our Agreement and What Will Happen if We Disagree” will remain in effect.

7. Our Agreement and Dispute Resolution

7.1. Our Agreement: Your use of music in the Service is also subject to the Spotify API Guidelines. The use of other features or services may include additional terms. In case of conflict, these additional terms will prevail. If any part of this agreement is deemed unenforceable, the remaining parts will remain in effect. Any changes or waivers to this agreement must be in writing and signed by us. Our failure to enforce any part of this agreement will not be considered a waiver. We reserve all rights not expressly granted to you.

7.2. Third-party rights: This agreement does not grant rights to any third parties. You may not transfer your rights or obligations without our consent. Our rights and obligations may be assigned to others, for example, in the case of a merger, acquisition, or sale of assets.

7.3. Limitation of Liability: Our Service is provided “as is,” without guarantees that it will be flawless or secure at all times. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We also do not control the actions or content of third parties and are not responsible for their conduct, online or offline, or for any content (including objectionable or illegal material). Our liability for any issue with the Service will be limited to the maximum extent permitted by law. You agree that we will not be liable for any loss of profits, revenue, information, or data, or for incidental, special, punitive, exemplary, or indirect damages arising from or related to these Terms, even if we have been advised of the possibility of such damages.

7.4. Dispute Resolution: If you are a consumer, the laws of your country of residence will apply to any claim against us, and you may resolve the dispute in a competent court in your country. In all other cases, you agree that the claim must be resolved exclusively in the District Court of Brazil for the State of Ceará in Fortaleza, and that the laws of the state of Ceará will govern these Terms, regardless of conflict-of-law provisions. However, Poosting Rede Social Ltda. may, at its discretion, bring actions against you in any competent court in your country of residence if the claim is related to attempts to abuse, interfere with, or use our products in unauthorized ways.

7.5. Unsolicited Material: Your suggestions are always welcome, but we may use them without restriction or obligation to compensate you, and we have no duty to keep them confidential.

8. Updates to These Terms

We may change our Service and our policies, and we may need to modify these Terms to reflect those changes. Except where required by law, you will be notified (for example, through our Service) before the changes take effect and will have the opportunity to review them. By continuing to use the Service, you will be agreeing to the updated Terms. If you do not agree to the changes or wish to terminate the agreement, you may do so by deleting your account and no longer using the Poosting Service.
